Code Rule 59
Purpose: The Workplace Safety and Loss Prevention program is intended to reduce workplace injuries and result in lower Workers' Compensation costs for employers. It is a mandated program in New York State
• An employer whose most recent annual payroll is in excess of $800,000.00 and whose most recent experience rating exceeds the level of 1.2
• If this criteria is met, the NYS DOL will notify the employer of the need for an audit by a certified safety consultant licensed by the NYS DOL for this purpose
• This will consist of an entry meeting, a site survey, a review of records
• A report will be generated which will outline modifications to be undertaken to improve the experience modification rating
• These modifications must be instituted to avoid a Workers’ Compensation premium surcharge

Code Rule 60
Purpose: A voluntary incentive program to promote workplace safety, health and performance. A reduction in the insurance premium of up to 10% is possible with full implementation of the program
The goal of the Workplace Safety and Loss Prevention Incentive Program is to help reduce the number and severity of injuries to people covered by the NYS Workers’ Compensation Board. Under this program, you may apply for a credit to your Workers’ Compensation insurance premium or security deposit. To qualify, start one or more programs that meet the standards outlined in Code Rule 60:

Safety and Health - A Safety Incentive Program prevents occupational illnesses and injuries by:
• identifying,
• preventing,
• evaluating, and
• controlling workplace hazards.
This program gives you a procedure to evaluate workplace hazards. It helps you develop ways to reduce and/or remove them.
Drug and Alcohol Prevention - A Drug and Alcohol Prevention Program explains the dangers of substance abuse in the workplace. The program gives employers tools to handle problems that are:
• low cost,
• confidential, and
• early-intervention.
This program can prevent accidents on the job caused by drugs and alcohol. The program also offers help to employees whose addictions keep them from working safely and effectively.

Return to Work - A Return to Work Program helps employees get back to work promptly and safely after a job-related injury or illness. The program sets fair and consistent practices to meet their needs.

VPP Gap Analysis-

• VPP is an opportunity for a workplace to partner with OSHA reserved only for those companies who are most committed to the culture of a safe and healthy workplace and to the actions required to achieve this.
• To maintain this relationship with OSHA it is necessary to reach a level of commitment and implementation which demonstrates these goals
• A gap analysis is a survey and review designed to determine what actions need to be taken to bring a workplace from its current state, to the level of excellence that will allow it to join those companies that have achieved this partner status with OSHA
• With over a decade of experience with OSHA in interacting with the VPP partnership program, the people of Access Compliance bring the expertise to work with employers to bridge this gap and gain recognition as a VPP partner.
