"The NYS Department of Labor recently released updated guidance on New York's COVID Sick Leave law. The guidance clarifies that (1) a quarantined/isolated employee does not need to be tested before returning to work, (2) if an employee does get tested and they continue to test positive, they must not report to work, (3) if an employer mandates that an employee who is not otherwise subject to a mandatory order of quarantine/isolation remain out of work due to a COVID exposure, the employer must continue to pay the employee at their regular rate of pay, and (4) employees cannot qualify for sick leave benefits for more than three quarantine/isolation orders."
